On 1 May 2026 the SBI and the Office of the Prosecutor General served Vitalii Hersak, former head of the SBU Department in Mykolaiv Oblast, a notice of suspicion of illicit enrichment (Article 368-5 of the Criminal Code of Ukraine). According to the investigation, in 2020–2021 he acquired assets whose value exceeds his lawful income by over UAH 22,666 thousand; in particular, in July 2021 his mother-in-law, who had no official income, registered two apartments and a non-residential premises in the capital's «Novopecherski Lypky» residential complex, later gifted to her daughter. The case was based on NACP lifestyle monitoring materials. The court imposed a pre-trial restraint measure — bail of UAH 10 million. In 2022 Bihus.Info reported new purchases by the family in 2021 worth approximately $2 million. Guilt has not been established by a court. The SBI's official announcement does not contain the name; the name was reported in the media.

In February 2020 Bihus.Info journalists reported that the family of Vitalii Hersak, then head of the SBU Department in Mykolaiv Oblast, acquired in 2017–2019 property that the journalists valued at over $800,000 in total: two apartments with parking spaces belonging to his wife in the Kyiv residential complex «Frantsuzkyi Kvartal» (about $400,000), half a hectare of land near Kyiv (about $200,000), and BMW X6, Lexus LX and a tuned Toyota Tundra bearing the official's initials, registered to his mother-in-law and mother. According to the investigation, the official income of his wife, mother and mother-in-law does not explain these purchases; the value estimates are the journalists'. No official criminal proceedings regarding the origin of this particular property have been registered (no information was found). Separately, in October 2020 the NACP found false information worth UAH 800,000 in Hersak's declaration and sent a reasoned conclusion to NABU; no data on a notice of suspicion based on this conclusion were found. Hersak's lawyer denied any violations.
