Attempted misappropriation of UAH 7 million of SE "Pivdendiproshakht" from the sale of an administrative building in Kharkiv through fictitious contracts

According to the HACC verdict of 15 February 2024, between November 2018 and November 2019 the acting director of SE "Pivdendiproshakht" Yurii Sevastianov and his deputy for legal affairs Oleksandr Tatarkin (at the time also director of LLC "Limited Edishn") concluded sham contracts for converting the state enterprise's paper archive into electronic form and, using promissory notes, created an artificial debt of the SE to a controlled company of UAH 7 million in order to recover funds received from the sale of the SE's administrative building in the centre of Kharkiv. The enforcement proceedings were suspended, so the offence was not completed (attempt). Notice of suspicion was served on 23 April 2021, the indictment in August 2021. The HACC sentenced Sevastianov to 7.5 years and Tatarkin to 7 years 3 months of imprisonment (Article 15(2), Article 191(5) of the Criminal Code). On 5 November 2024 the Appeals Chamber of the HACC upheld the verdict — it entered into force; on 20 November 2025 the Criminal Cassation Court of the Supreme Court upheld the verdict and the ruling of the Appeals Chamber.
