According to the Kyiv prosecutor's office (as retold by LB.ua, 2014), in 2011–2012 NJSC “Ukrahrolizynh”, headed by M. Shpak, concluded an agreement with a farm for the purchase of machinery and equipment worth UAH 110 million, of which only UAH 9 million was spent for the intended purpose; the rest of the funds, according to investigators, were transferred to accounts of controlled fictitious companies. In August 2014 a notice of suspicion under Article 191(5) of the Criminal Code was served; M. Shpak's whereabouts were being established at the time. According to TI Ukraine (“HACC Decided”), the charges concerned the possible misappropriation of the company's UAH 115 million (the episode amount is according to TI), and the case was heard by the HACC; in early 2022 the materials concerning M. Shpak were separated into separate proceedings because he had been mobilised into the Armed Forces of Ukraine. A co-defendant in the case, a former Member of Parliament, died in 2023. As of 3 October 2026 the outcome regarding M. Shpak has not been checked; there is no verdict in available sources, and the person is presumed innocent.
