NABU case on illicit enrichment of a military prosecutor of the ATO forces (UAH 2.6 million in expenses exceeding income), closed after the Constitutional Court ruling

According to NABU, in 2011–2015 military prosecutor of the ATO forces Kostiantyn Kulyk received a total income of more than UAH 1.67 million, while his expenses exceeded his income by UAH 2.6 million and amounted to about UAH 3.4 million (Article 368-2(2) of the Criminal Code, "Illicit enrichment"; proceedings No. 52015000000000017 of 25.12.2015). On 29.06.2016 a notice of suspicion was served, on 07.10.2016 the pre-trial investigation was completed, and on 21.10.2016 the indictment was sent to court. Other sources cite other figures: according to the investigators' version as recounted by Slovo i Dilo, Kulyk and his partner acquired real estate with a total value of UAH 2.86 million, the lawfulness of whose acquisition has not been confirmed; a Bihus.Info story mentions almost UAH 3 million in expenses with funds of unclear origin. The episode amount is UAH 2.6 million according to NABU. On 26.02.2019 the Constitutional Court declared Article 368-2 of the Criminal Code unconstitutional; on 02.04.2020 the High Anti-Corruption Court, at SAPO's request, closed the criminal proceedings under Article 284(1)(4) of the Criminal Procedure Code (criminal liability for the act abolished). The ground for closure is decriminalisation, which is not exonerating: guilt has been neither established nor refuted by a court. There is no verdict.
