On 15.11.2018 a SAPO prosecutor drew up in absentia a notice of suspicion of illicit enrichment (Article 368-2 of the Criminal Code) against former acting head of the State Fiscal Service Myroslav Prodan: according to investigators, while serving as acting deputy head and acting head of the State Fiscal Service (July 2016 — June 2018), he acquired assets worth more than UAH 89 million — two apartments in a new building in the capital (UAH 6.7 million), two houses in Turkey (UAH 78 million) and three executive-class cars (UAH 3.4 million). The investigation was conducted by NABU detectives. Other sources cite other figures: Bihus.Info — UAH 86 million, a headline by Ukrainski Novyny — UAH 90 million. Prodan denied the accusations, and his lawyer claimed the case had been fabricated. After the Constitutional Court of Ukraine decision of 26.02.2019 declaring Article 368-2 of the Criminal Code unconstitutional, the case was closed (media reports of March 2019; NABU then stated that all proceedings under this article were to be closed). On 16.05.2019 the court lifted the seizure of his property due to the closure of the case. The ground for closure is decriminalisation, which is not exonerating: guilt has been neither established nor refuted by a court. No official procedural document on the closure has been found in the public domain.
